On oral prayer made by Sri S.K. Mishra, learned counsel for the petitioner, he is permitted to implead the Gaon Sabha concerned as party-respondent No. 4 in the Writ Petition as well as in the Stay Application.
Necessary impleadment will be done during the course of the day.
On prayer made by Sri S.K. Mishra, learned counsel for the petitioner, the case is directed to be put up as fresh on 30th September, 2013 so as to enable him to file Supplementary Affidavit annexing thereto, a certified copy of the complete Order-Sheet of the Appeal stated to have been filed by the petitioner before the Divisional Commissioner concerned.
Copy of the Stay Application, if any, filed on behalf of the petitioner in the said Appeal, may also be filed along with the Supplementary Affidavit.
In the meantime, learned Standing Counsel appearing for the respondent Nos. 1, 2 and 3 may obtain instructions in the matter, particularly, in regard to the averments made in Paragraphs 5, 6 and 7 of the Writ Petition.
