Heard learned counsel for the applicant and learned A.G.A.
From the perusal of the record it appears that the applicant is husband of the deceased. The marriage of the deceased was solemnized about six years prior the alleged incident. The deceased has died and trial of the applicant is in progress. The witnesses of the facts have not supported the prosecution story as submitted by learned counsel for the applicant.
In such circumstances, the applicant is not entitled for bail. The prayer for bail is refused.
However, considering the submission made by learned counsel for the applicant that the witnesses of the facts have not supported the prosecution story, it is directed that the proceeding of the trial shall be expedited without granting any unnecessary adjournment to either of the side.
Accordingly this application is disposed of.
