The appellant Moti Lal Master has been found guilty by learned Additional Sessions, Court no.2, Kushinagar at Padrauna in S.T. No.127 of 2000 arising out of Case Crime No.26 of 2000, P.S. Ram Kola, District Kushinagar and sentenced to 3 years R.I. under section 366 I.P.C. It has been submitted from the side of the appellant that he is on interim bail in this case till today. I have perused the record.
The bail prayer has been opposed by the learned A.G.A.
Keeping in view the facts and circumstances of the case and the role assigned to the appellant, I am of the view that the appellant may be allowed to remain on bail in the above mentioned case if he furnishes fresh bail bonds to the satisfaction of the court concerned. No fine is stayed.
