Heard learned counsel for the applicant and learned A.G.A. for the State.
It has been contended by learned counsel for the applicant that there is sanguine hope of compromise between the parties and this case may be sent to Mediation Center for the purpose of settlement between the parties for which the applicant is ready to deposit the cost.
Considering the submission made by learned counsel for the applicant, it is directed that the applicant shall deposit Rs. 3,000/- within three weeks from today with the Mediation Center at Amroha. In case the aforesaid amount is deposited within the time as mentioned above the notice shall be issued by the Mediation Center concerned to opposite party no. 2. The 2/3rd of the abovementioned deposited amount shall be paid to opposite party no. 2 as expenses.
This case shall be sent to Mediation Center at Civil Court, Amroha for further proceedings. The Mediation Center, Amroha shall entertain the mediation only if the money is deposited within the time allowed.
After completion of the mediation proceedings at the Mediation Center at Amroha the center shall submit its report without any delay to this Court. Thereafter this case shall be listed immediately before the appropriate bench.
If the money is deposited in time and receipt thereof is filed with the Mediation Center, then no coercive steps shall be taken against the applicant in Complaint Case No.225 of 2013 (Suresh Kumar Agarwal Vs. Lalit Agarwal), under Sections 138 N.I. Act, Police Station Hasanpur, district Amroha pending in the court of learned Judicial Magistrate, Hasanpur, District Amroha.
The applicant and opposite party no. 2 are directed to fully cooperate with the proceedings of the Mediation Center. The Mediation Center shall conclude the mediation proceedings within 60 days from the date a certified copy of this order is produced before it.
