In so far as the case of the petitioner in the matter, regarding the settlement of the contract by Nagar Nigam is concerned the petitioner has failed to establish that he had submitted any tender in response to the advertisement.
The writ petition is dismissed. However, liberty is granted to the petitioner to file a civil suit if he so desires.
