(C.M.A.No.48633 of 2013) This application for recall/modification of order dated 29.4.2013 has been filed with the plea that Chandra Bhushan Srivastava is serving as Assistant Review Officer in the office of the Government Advocate. It has been stated that by unintentional error information could not be given to the court in time and, therefore, apology has been tendered.
In view of contention of Sri Rajendra Kumar Dwivedi, learned Government Advocate, which is supported by affidavit of the concerned official, order dated 29.4.2013 is hereby modified. Costs of Rs.1000/- (One thousand only) would be deposited with Oudh Bar Library, which will not be recovered from the officer/official concerned.
It has been clarified that no government appeal against acquittal has been filed.
