The petitioner has been appointed as an Aaganbari Sahaiyka on 15.6.2007. In pursuance of the appointment, the petitioner has joined on 21.6.2007. On 8.12.2010, the petitioner has been restrained to work on the ground that the appointment has not been approved by the competent authority. On 17.10.2012, learned Standing Counsel was directed to seek instruction that what was the procedure for appointment of Aaganbari Sahaiyka and the approval of which competent authority was required under the scheme, which could not be obtained in the case of the petitioner.
Ms. Suman Sirohi, learned Standing Counsel states that under the scheme only the Selection Committee is the authority to select and appoint Aaganbari Sahaiyaka. No approval of any other authority is required. However, she prayed for and is granted four weeks time to file counter affidavit.
List in the week commencing 10.12.2012. Meanwhile, the operation of the order dated 19.10.2010 passed by the District Programme Officer, Ghazipur and the operation of the order of the District Magistrate, Ghazipur dated 31.5.2012 shall remain stayed. The respondent is directed to allow the petitioner to work and the honorarium shall be paid.
