Petitioners before this Court seek quashing of the first information report dated 02.02.2011, registered as Case Crime No. 08 of 2011, under Sections 498A, 323, 504, 506, I.P.C. and 3(1)X SC/ST Act and 3/4 D.P. Act, Police Station-Mahila Thana, District-Gautam Budh Nagar. Kanpur Nagar.
Under order of the Court dated 17.02.2011 the matter was referred for mediation, being matrimonial in nature. Report of the mediation centre dated 02.08.2011 records that mediation has been completed but no agreement could be arrived at.
We have gone through the first information report. It does disclose a cognizable offence and therefore no case is made out for quashing of the first information report.
Writ petition is dismissed. Interim order, if any, stands discharged.
Learned A.G.A. shall forward a copy of this order to the S.P./S.S.P. concerned for the investigation being completed with due diligence, if not already completed.
