Petitioner seeks quashing of the first information report dated 17.07.2012, being case crime no. 422 of 2012 under Section 138-B of the Electricity Act, 2003.
Counsel for the petitioner submits that in the first information report it is alleged that the petitioner was unauthorizedly using the electrical energy and had connected a load of 1 Kilo Watt. He submits that the offence is compoundable.
Counsel for the respondent submits that the petitioner may be put to terms before any protection is granted in his favour by the Court.
In the facts and circumstances of the case, we are of the opinion that the petitioner may deposit a sum of Rs. 5,000/- within one month from today. If this is done, it is further directed that the petitioner shall not be arrested till the submission of the police report. Investigation shall be completed within three months. Deposit shall be subject to the assessment proceedings to be initiated.
Writ petition is disposed of.
