The contention of the petitioner is that though the Deputy Director of Education while allowing the appeal of the Committee of Management has directed to pass consequential order of termination but no order of termination has been passed by the Committee of Management and, therefore, the petitioner is deemed to be in service.

Sri H.N. Tripathi, learned counsel appearing for the respondent is directed to file supplementary affidavit stating therein whether in pursuance of the order of the Deputy Director of Education, any consequential order has been passed, which has been communicated to the petitioner and served upon him or not.
