Connect this writ petition with Writ Petitions No. 154 of 2010, 1576 of 2010, 85 of 2011 and 662 of 2012.
Shri Nishant Mishra, learned counsel for the petitioner submits that issue raised in the present writ petition is same as has been raised in aforesaid writ petitions in which interim protection has been provided to the effect that the petitioner shall furnish security other than cash or bank guarantee of the amount involved in the case. He submits that this writ petition also challenges the validity of Sub-rule (3A) of Rule 8 of the Central Excise Rules, 2002. Intra-virus of Rule 8(3A) has been challenged in the aforesaid petitions.
Notice to Attorney General of India has already been issued in Writ Tax No. 154 of 2010. Sri B.K.S. Raghuvanshi appears for the respondent. He states that the matter has already been fixed on 2nd July, 2012.
List on 2nd July, 2012 along with aforesaid writ petitions.
Counter affidavit may be filed by the next date.
In the meantime, the petitioner shall funish security other than cash or bank guarantee for the amount of Rs.59,47,127/- within a period of two months as mentioned in the letter dated 9th May, 2012, Annexure-5 to the writ petition.
