Learned counsel for the petitioner contends that the petitioner is ready to rehabilitate respondent no.2 at his home. Respondent no.2, however, has been resisting the offer of the petitioner given through Mediation and Conciliation proceedings also. The offer is still open. In such circumstances, it cannot be said that offence under the Domestic Violence Act has been committed.
Issue notice to respondent no.2 through Chief Judicial Magistrate, Sitapur, for 24.7.2012.
Respondent no.2 and the petitioner are directed to remain present in court on the next date of listing.
Operation of order, Annexure-1, shall remain stayed till the next date of listing.
