In response to order dated 25.4.2012, respondent no.2, as identified by her counsel Sri Om Prakash Yadav, Advocate, has put in appearance.
Learned counsel for the petitioners contends that the respondent no.2 has resorted to malicious and vexatious litigation. A petition for divorce was filed in which despite service of notice, respondent no.2 did not put in appearance before the court of law. An ex-parte decree of divorce was passed. In counter-blast to the decree of divorce, present proceedings have been initiated.
It transpires that decree of divorce has not been challenged in any court of law till now.
Let the case be listed for final disposal on 17.7.2012.
