In view of the arbitration clause 18 of the agreement dated 3.12.2008, petitioner is seeking appointment of an arbitrator as despite notice dated 1.1.11 the matter had not been referred to the arbitrator.
Learned Standing Counsel has accepted notice on behalf of respondent nos. 1 and 2 and is allowed a month's time for filing counter affidavit. Two weeks thereafter are granted to file rejoinder affidavit.
List on the expiry of the above period.
