Learned counsel for the petitioner contends that at the verge of attaining age of superannuation, notice was given to the petitioner for alleged losses caused in storage of foodgrains during the period from September 2004 to November 2005. The show-cause notice was given in the year 2010. On the said premise, the leave encashment is not being permitted.
Sri R.K. Chaudhary, Advocate puts in appearance for the respondents and prays for two weeks' time to file counter affidavit.
List after four weeks.
On filing counter affidavit, rejoinder affidavit, if any, be filed.
