Learned counsel for the respondent has pointed out that it is has been held by the Hon'ble Supreme Court of India in (2007) 1 UPLBEC 962, Noida Enterpreneurs Association v. Noida & ors., that criminal proceedings and disciplinary proceedings can co-exist and, therefore, order of stay be vacated. Similar view has been taken by the Hon'ble Supreme Court in (1996) 6 SCC 417, State of Rajasthan v. B.K. Meena & ors.
Taking into account the legal position, as contended by learned counsel for the respondent, interim direction is vacated.
