The contention of the petitioner is that in pursuance of the transfer order, the petitioner has joined the transferred place and, therefore, the cancellation of the transfer order is not justified.
On 29.9.2011, learned Standing Counsel was directed to seek instruction whether the petitioner has joined the transferred place or not. He states that the petitioner has joined the transferred place.
In view of the fact that the petitioner has joined the transferred place, the cancellation of the earlier order, prima facie, appears to be unjustified.
Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the operation of the impugned order dated 30.8.2011 by which the transfer order dated 4.7.2011 has been cancelled shall remain stayed.
