It is contended by the learned counsel for the petitioner that the Revisional Court while hearing the revision against the order of Executing Court has held that decree has attained finality but the case of the petitioner is that the civil appeal filed against the judgment of the 1st Appellate Court is still pending in this Court, as such, the decree has not attained finality.
Till the next date of listing, the proceeding of Execution Case No. 10 of 2006 (Smt. Sarla Devi Vs. Mahesh Chand and others), pending in the Court of Civil Judge (Sr. Division), Court No.2, Ghaziabad shall remain stayed.
