The contention of the petitioner is that his father was engaged as a Driver and he died on 9.8.2010. The petitioner is claiming compassionate appointment. The claim of the petitioner has been denied on the ground that the father of the petitioner was not Government employee and in the appointment letter dated 10.1.1991 it has been clearly mentioned that he will not be treated as Government servant.
The contention of the petitioner is that his father worked for more than 8 years and he has been given promotional grade and further the Government Order dated 8.12.2008, which is Annexure-7 to the writ petition, he has been treated Government servant. Therefore, the view taken by the respondent is not correct and the petitioner is entitled for compassionate appointment.
The matter requires consideration.
Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
