The case set out by the petitioner is that while constituting the Appellate Committee under Section 11 of the Uttar Pradesh Private Professional Educational Institutions (Regulation of Admission & Fixation of Fee) Act, 2006, what is provided is that such Appellate Forum is headed by a retired Judge of the High Court. This has been interpreted by the respondents to mean more than one member.
Issue notice to the respondents returnable at an early date. They may file counter affidavit within two weeks.
