For the post of Assistant Pharmacist to fill up 57 vacancies by direct recruitment on the post of Analytical Assistant (Drugs) in department of Food and Drugs, Administration, an advertisement was issued by the U.P. Public Service Commission, Allahabad on 7.5.2011. Subsequently on 29.8.2011 a corrigendum has been issued asking only those candidates, who belong to General Category obtained 69% marks, to S.C. Category obtained 64% marks, to O.B.C Category obtained 69% marks and to Freedom Fighter category obtained 56% to apply.
Learned counsel for the petitioner states that such corrigendum cannot be issued to amend the original advertisement by which the right of the petitioner has been taken away.
Sri Gautam Baghel, Advocate holding brief of Sri Pushpendra Singh, advocate, who appears on behalf of respondent nos. 2 and 4, prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
