Heard learned counsel for petitioner and Sri Neeraj Tiwari, Advocate for respondent-University.

Petitioner has rushed to this Court with request that permission be accorded to her to take admission in B.Sc. II years (PCM Group) in P.D. Mahila P.G.College Fatehgarh Farrukhabad.

On the matter being taken up  today Neeraj Tiwari Advocate has produced the relevant Ordinance which holds the field of transfer of one student from one college to another and his precise contention is that till today Principal of Kanpur Vidya Mandir P.G. College, Swaroop Nagar Kanpur has not given No Objection Certificate in black and white so t request of the petitioner could be considered.

As there is no permission in black and white of the Principal of Kanpur Vidya Mandir P.G. College, Swaroop Nagar Kanpur, in such factual situation the pre-requisite term and condition for considering the transfer of the petitioner is not at all admittedly fulfilled in such a situation this Court cannot issue futile writ.

However, in case proper application is moved by the petitioner fulfilling the requisite term and same be considered in accordance with law.

With the above direction present writ petition is disposed.
