By the impugned order the recovery is being sought in respect of the amount which has been paid in excess.

Learned counsel for the petitioners submitted that the amount sought to be recovered without making out a case of misrepresentation or fraud and, therefore, recovery is not justified.

Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.

List thereafter.

Till the next date of listing, the operation of the impugned order dated 17.8.2011, which are Annexures-3 and 4 of the writ petition, shall remain stayed.
