The contention of the petitioner is that now the Department is recovering certain amount which, according to the Department, has been paid in excess without making out of a case of misrepresentation or fraud.
Smt. Radhika Srivastava, Advocate appears on behalf of respondent no. 2 states that the petitioner has been paid excess amount not towards salary but certain deduction has not been made while making the salary.
Let the respondents may file counter affidavit within a period of four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List immediately thereafter.
Till the next date of listing, the realization of the alleged excess amount shall remain stayed. If anything is due outstanding payable by the respondent to the petitioner to the extent the amount which is being recovered shall only be retained till the final decision of the writ petition.
