The present habeas corpus petition has been registered on the basis of a telegram sent by one Smt. Vandana Vardhan Singh wife of Sri Raj Vardhan Singh, R/o Neev Purwa, Hardoi.
A counter affidavit has been filed on behalf of the State duly sworn by Sri Lav Kumar, Superintendent of Police, Hardoi.
In para nos. 4, 5 and 6 of the counter affidavit, it has been averred that Virendra Kumar Singh was arrested on 16.08.2011, at 2.30 P.M. in connection with Case Crime No. 1841 of 2011, under Sections 406, 420, 504, 506, 323 I.P.C., P.S.-Kotwali Shahar, District-Hardoi. He was produced before the court of learned Chief Judicial Magistrate, Hardoi within 24 hours of his arrest. From where, he was sent to District Jail, Hardoi. Hence, no case of illegal detention is made out.
The habeas corpus petition is dismissed being devoid of merits.
