Learned counsel for the petitioner submitted that the petitioner is Gram Vikas Adhikari and the District Development Officer, Sonebhadra has no jurisdiction to pass the suspension order. He submitted that this issue is under consideration before this Court in various writ petition, one of the writ petition number is Writ Petition No.50934 of 2009 and interim order has been granted after passing a detailed order. To maintain the parity, the similar order is being passed in the present case also as has been passed in the aforesaid writ petition in view of the reasoning given in the aforesaid order.

Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within three weeks thereafter.
The suspension order dated 14.07.2011 passed by District /Development Officer, Sonebhadra, annexure-1 to the writ petition, shall remain stayed. However, the authority concern may conclude the departmental inquiry and pass appropriate order expeditiously in accordance to law.
