Learned counsel for the petitioner submitted that the respondent is realizing the excess payment towards salary vide order dated 13.7.2011. No case of misrepresentation or fraud is made out and, therefore, recovery is not justified.
Learned Standing Counsel may file counter affidavit within a period of four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the realization of recovery against the petitioner in pursuance of the order dated 13.7.2011 shall remain stayed.
