Learned counsel for the appellant states that appellant no.2 Smt. Buddha Kunwar died in the year 1997 and a substitution application was filed with the prayer that name of appellant no.2 might be struck off from the array of the parties and a note be made to the effect that she died and survived by appellant no.1 in whose favour she had executed a Will. The said application is not available on record. Oral prayer in that regard is made by the learned counsel for the appellant which is accepted and it is directed that the name of respondent no.2 be deleted from the array of the parties and a note be made as above against her name.
