Heard the learned counsel for the applicant and the learned A.G.A.
It is contended by the learned counsel for the applicant that in the present case complaint has been filed by O.P. No.2 was dismissed under section 203 Cr.P.C. on 5.5.2008 and the order dated 5.5.2008 has been challenged by O.P. No.2 by way of filing a criminal revision no. 211 of 2008, the same has been allowed in which the revisionist applicant was not made a party, which is requirement prescribed by the Act itself vide section 398 Cr.P.C.
Issue notice to O.P. No.2 returnable within six weeks.
Considering the same, the operation of the impugned order dated 18.11.2009 passed by the learned Sessions Judge, Court No.8, Rae-bareli, shall remain stayed till the next date of listing.
