This application has been filed with a prayer to quash the order dated 22.9.2011 passed by learned S.D.M. Haidergarh, Barabanki under section 111 CR.P.C. in case No. 896 of 2011.
From the perusal of the impugned notice it appears that the general nature of material allegation has not been mentioned therein, in such circumstances, it is very difficult to the applicant to file proper reply. The impugned notice is illegal and the same is set aside.
However, it shall be open to the authority concerned to pass a fresh order under the provisions of law.
With this direction, this application is finally disposed of.
