Sri Lait Shukla, Addl. C.S.C. has raised the question about the maintainability of the contempt petition. Writ petition no. 58999 (C ) of 2010 was filed at Allahabad. He says that the contempt petition is maintainable at Allahabad and not at Lucknow.
Counsel for the petitioner has stated that the Institution as well as the University, both are situated at Lucknow. Hence, he has to file contempt petition at Lucknow. He, however, says that he does not want to press this contempt petition and the same may be dismissed as withdrawn.
Accordingly, the contempt petition is dismissed, as withdrawn.
However, the petitioner shall have the liberty to file afresh petition at Allahabad, if he so chooses.
