An order was passed in favour of the petitioner on 11.2.2011. There was an order of reinstatement of the petitioner. The order has not been complied with. Counter-affidavit has been filed that a special appeal has been filed against the said order.
The petitioner's counsel says that the special appeal is delayed and delay has not been condoned till date.
Sri Lalit Shukla, Addl. Chief standing counsel says, on the other hand, that the special appeal is only of 2-3 months delayed. This is likely to be condoned.
In any view of the matter, the order of the Single Judge is not modified or changed. It remains binding on the opposite parties and they have to comply with the Court's order.
On the request of the Chief standing counsel four weeks' further time is allowed to either obtain an order in the special appeal or to comply with the Court's order.
List this case on 23.11.2011.
In case the orders are not complied with, the opposite party shall appear in person before this Court on the next date of listing.
