Heard learned counsel for the applicants and learned A.G.A.
This application has been filed with a prayer that a suitable direction may be issued to the court below for releasing the applicants on same bail bonds under section 413 IPC in case crime NO. Nil of 2008, P.S. Ajgain, District Unnao.
It is contended by learned counsel for the applicants that in the present case the applicants have been released on bail under section 102/411 IPC and they are ready to furnish the same bail bonds under section 413 IPC which has been subsequently added.
In reply of the above contention, it is submitted by learned A.G.A. that remedy of obtaining the bail is available to the applicant, therefore the direction for accepting the same bail bonds may not be issued.
Considering the the submission and from the perusal of the record it appears that in the present case the applicants have been released on bail under sections 102/411 IPC, subsequently section 413 IPC has been added and the remedy of obtaining the bail is available, therefore, the prayer for accepting the same bail bail bonds is refused.
However, it is directed that applicants shall appear before the court concerned within 30 days from today, in case they appear and apply for bail under added section 413 I.P.C. same shall be heard and disposed of on the same day by the courts below.
With this direction, this application is finally disposed of.
