In the present case counter affidavit has been filed on behalf of the University concerned and therein precise stand sought to be taken is that there is no entry qua the petitioner in the University Tabulation Chart showing his name or Roll Number showing his appearance in B.A. II examination in the year 2006 from Sri Baba Sadhav Ram Post Graduate College, Koinaha, Barsra, Khalsa, Azamgarh. From the record of the University, it is not feasible to declare the result of the petitioner, as has been claimed by him.
On the basis of the short counter the University disowns the claim of the petitioner. Since the petitioner claims to have appeared in the examination in question from Baba Sadhav Ram Post Graduate College, Koinaha, Barsra, Khalsa, Azamgarh, as such the Principal of the said institution would be in a better position to explain the correct situation qua the claim of the petitioner. Let fresh notices be issued to the Principal, Baba Sadhav Ram Post Graduate College, Koinaha, Barsra, Khalsa, Azamgarh. The Principal, Baba Sadhav Ram Post Graduate College, Koinaha, Barsra, Khalsa, Azamgarh, apart from filing counter affidavit, is directed to produce entire relevant record qua the claim of petitioner. The representative of the University is also directed to remain present in Court on the date fixed along with relevant record.
