The petitioner claims that he has been appointed as Gram Rozgar Sewak in the month of July, 2008. Further contract has been renewed for the year 2009-10 and again for the period 1.7.2010 to 30.6.2012 and, therefore, during the subsistence of the contract his renewal without following the proper procedure is not justified.
Government Order dated 23.11.2007 provides that the Gram Rozgar Sewak can be engaged initially for a period of one year and having regard to the performance his services can be renewed maximum for a period of two years. Three years period have been expired in the month of June, 2011. How the contract for the period 1.7.2010 to 30.6.2012 has been executed. It appears that the contract is contrary to the aforesaid Government Order.
Sri Mahesh Narain Singh, learned counsel appearing on behalf of respondent no. 7 is directed to seek instruction in the matter that under which circumstances the contract beyond the period of three years has been executed.
