Learned Standing Counsel filed an affidavit annexing a copy of the order dated 14.9.2011 passed by the Chief Engineer by which he has cancelled the impugned advertisement. In this view of the matter so far as relief nos. 1 & 2 are concerned, the same have become infructuous.
Learned counsel for the petitioner submitted that so far as relief no. 3 is concerned, nothing has been said in the affidavit. Therefore, learned Standing Counsel is required to file counter affidavit in respect of relief no. 3.
Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit.
Learned counsel for the petitioner has filed reply to the affidavit filed by the respondents. The same may be placed on record.
