Put up on Monday to enable learned counsel for the appellant to produce or refer to the Government Order, under which the post admittedly reserved and advertised for a Scheduled Caste candidate was filled up by appointment of petitioner as a general candidate. The District Inspector of Schools has disapproved the appointment against the the writ petition was dismissed. A liberty was given to the petitioner to file a representation. An order was passed in the year 1997 by the Deputy Director of Education for payment of petitioner's salary on the ground that once the SC candidate was not available, under the Rules the post  could be filled up by the general candidate. The petitioner was, however, not paid salary on which he filed the writ petition which was disposed of directing the representation to be decided. The second writ petition has been dismissed on the ground that relief for directing the representation to be decided has already been granted to the petitioner giving rise to this Special Appeal.

A  restoration application has been filed to recall the order dated 8.9.2010 dismissing the Special Appeal for want of prosecution. The cause shown is sufficient. The restoration application is allowed. The order dated 8.9.2010 is recalled. The Special Appeal is restored to its original number and was heard.
