The petitioner is challenging the order dated 25.8.2011 by which the notional second promotional pay-scale has been denied. The petitioner retired on 31.1.2009. The notional second promotional pay-scale has been denied on the ground that the petitioner has been awarded penalty on 4.9.1999 and on 27.2.2004 and he was suspended on 14.2.2003 from 14.2.2003 to 27.2.2004. In paragraph-25 of the writ petition, the petitioner stated that the order dated 4.9.1999 has never been communicated to the petitioner inasmuch as the order dated 27.2.2004 is after the completion of 24 years service, the said penalty order cannot be considered to deny the notional promotion.
Learned Standing Counsel may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
