Shri N.N. Mishra, appearing for Nagar Nigam, Ghaziabad has not produced the justification of increase of house tax from Rs. 1060/- in the year 2008-09 to Rs. 30,175/- in the year 2009-10.
It is stated in the writ petition that the petitioner has not made any addition nor the rates of the land and building have been fixed at such a high rate to increase the house tax to such an extend.
Shri N.N. Mishra is allowed two week's time to file counter affidavit.
List on 20.12.2011.
In the meantime the realisation of increased house tax, water tax and sewerage tax shall remain stayed. The petitioner will continue to deposit the house tax, water tax and sewerage tax at the rates, which were determined in the year 2008-09.
