The petitioner sought voluntary retirement w.e.f. 30.9.2011. By the order dated 22.8.2011 the voluntary retirement service w.e.f. 30.9.2011 has been accepted and the order for pension has also been passed. The said order has been cancelled vide impugned order dated 27.9.2011 on the ground that the petitioner has a dispute with the wife.
The Court is not able to understand that if there is any dispute with the wife how it will affect the voluntary retirement.
Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
List in second week of January, 2012.
Until further orders, the operation of the order dated 27.9.22011, Annexure-3 to the writ petition, shall remain stayed.
