Prayer for bail has been made on behalf of the appellants, who have been convicted by Additional Sessions Judge Court No.1, Jaunpur in S.T. No.316 of 2008 under Sections 307, 504, 506 I.P.C.
Heard learned counsel for the appellants and the learned A.G. A. for the State and perused the lower court's record.
Learned counsel for the appellants submitted that maximum sentence awarded to the appellant is ten years and the appeal is not likely to be heard in near future.
Learned A.G.A opposed the prayer for bail.
Considering the facts and circumstances of the case, in my opinion the appellants are entitled to be released on bail.
Pending appeal appellants Kamala and Sabhajeet are convicted in S.T. No. 316 of 2008 shall be released on bail on their executing a personal bonds and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine, if any, shall also remain stayed.
