Prayer for bail has been made on behalf of the appellants, who has been convicted by Additional Sessions Judge Court No. 7, Farrukhabad in S.T. No.42/97 under Sections 460, 411 I.P.C.
Heard learned counsel for the appellants and the learned A.G. A. for the State and perused the lower court's record.
Learned counsel for the appellants submitted that according to the First Information Report stolen articles were recovered from the possession of appellant no.1. It is further submitted that names of rest of the appellants were disclosed in the statement under Section 161 Cr.P.C.
Learned A.G.A opposed the prayer for bail.
Considering the facts and circumstances of the case, in my opinion appellant no.1 Man Singh is not entitled for bail and his bail prayer is rejected. So far as the case of other appellants is concerned, in my opinion they are entitled for bail.
Pending appeal appellants Vishram, Mannu and Ram Kumar convicted in S.T.No.42/97shall be released on bail on their executing a personal bonds and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine with regard to appellant nos.2,3 and 4, if any, shall also remain stayed.
List this appeal for final hearing in the month of March,2012.
