Heard learned counsel for the parties.
The petitioner is the grand son (Nati) of the deceased employee (Nana), who died in harness in the year 1996. The petitioner is claiming the compassionate appointment.
The petitioner's claim for the compassionate appointment cannot be considered as the petitioner does not fall within the ambit of the family as defined under Section 2(c) of the U.P. Recruitment of Dependents of Government Servants (Dying-in-Harness) Rules, 1974 inasmuch as the application has been moved in the year 2011, that is, much after the period of five years.
In view of the above, the writ petition is devoid of merits and is, accordingly, dismissed.
