The petitioner is the Senior Malaria Inspector. By the impugned order, recovery is being sought on the ground that on account of the action of the petitioner, there is a revenue loss.
Learned counsel for the petitioner submitted that the petitioner has been suspended on 7.6.2010. The petitioner filed writ petition in this Court wherein the suspension order has been stayed. However, the respondent has been directed to proceed for the inquiry but the inquiry has not been proceeded and on 29.2.2010 the writ petition has been allowed and the suspension order has been quashed. However, the respondent has again permitted to conclude the inquiry. According to the petitioner, inquiry has not been concluded inasmuch as no further inquiry has been made and without giving any opportunity, the impugned order has been passed.
Learned Standing Counsel submitted that the matter may be taken up on Tuesday i.e. on 15.11.2011 to enable her to seek instruction in the matter.
Put up on Tuesday i.e. on 15.11.2011 as fresh.
