The petitioner was appointed as Mini Aaganwadi Karyakatri. By the impugned order, her appointment has been cancelled on the ground that on inquiry High School Certificate was found forged. It is stated that, in fact, she obtained only 298 marks and passed in second division while she has shown to have obtained 423 marks, out of 600 marks, and shown to have passed first division.

Learned counsel for the petitioner submitted that in the application form, the petitioner has disclosed 298 marks only and annexed the copy of the mark-sheet wherein only 298 marks have been given and passed in second division. Therefore, the allegation is baseless. He further submitted that the impugned order has been passed without giving proper opportunity of hearing.

The contention of the petitioner has substance.

Learned Standing Counsel is directed to seek instruction and produce the record on 11.11.2011.
