Prayer for bail has been made on behalf of the appellant, who has been convicted by Additional Sessions Judge/F.T.C. V, Court No. 14, Sultanpur in S.T. No. 126/2006, under Sections 376, 307, 323, 506 & 341 I.P.C., P.S. Jagdishpur, District Sultanpur.
Heard learned counsel for the appellant and the learned A. G. A. for the State and perused the lower court's record.
Learned counsel for the appellant submitted that maximum sentence awarded to the appellant is seven years and he has already been served out more than two years. The appellant was on bail during the trial. The appeal is also not likely to come up for final haring in near future.
Learned A. G. A. opposed the prayer for bail of the appellant.
Considering the facts and circumstances of the case in my opinion appellant is entitled to be released on bail.
Pending appeal appellant Ram Sundar convicted in S. T. No. 126/2006, under Sections 376, 307, 323, 506 & 341 I.P.C., P.S. Jagdishpur, District Sultanpur, shall be released on bail on his executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine, if any, shall also remain stayed.
