The petitioner is a daughter of the deceased employee, who died in the year 2006. The contention of the petitioner is that she applied for compassionate appointment under the Dying in Harness Rules, 1974 immediately after the death of her father and fulfilled all the requirements. However, the application has been kept pending for long time. Admittedly, she is married. The claim of the petitioner has been rejected on the ground that she is now married and, therefore, appointment under the compassionate ground cannot be given under the said Rules.
Learned counsel for the petitioner submitted that when the petitioner applied for compassionate appointment, she was eligible and, therefore, compassionate appointment should be given. To support the contention, learned counsel for the petitioner submitted that the matter may be taken up day after tomorrow.
Put up day after tomorrow i.e. on 3.11.2011 as fresh.
