The petitioner is permitted to correct the array of the party.
The petitioner is a Sub-Inspector. By the impugned order the petitioner has been asked to pay a sum of Rs.50,000/- in pursuance of the order of the Human Right Commission.
Learned counsel for the petitioner submitted that the charges for which the petitioner has been asked to pay, the petitioner has been subjected to punishment and against which the appeal has been allowed and the petitioner has been exonerated and the petitioner was not found guilty and therefore, the recovery cannot be made for the said cause. He further submitted that the Human Right Commission has no right to fix any compensation and issue in this regard is pending in this Court in several writ petitions.
The matter requires consideration.
Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Until further orders, the impugned order dated 30.9.2011, Annexure-14 to the writ petition, shall remain stayed.
