Heard learned counsel for the parties and perused the record.
During the course of hearing, learned counsel for the petitioner invited attention towards Government Order dated 11.2.3003 which provides that since there is no seniority list of the Assistant Engineer, those Assistant Engineers who are discharging duty on the post of Deputy Director, status quo shall be maintained.
Learned counsel for the opposite parties states that in case the petitioner intends to continue on the post of Deputy Director in terms of Government Order dated 11.2.2003, opposite parties are ready to keep him on the post of Deputy Director in head office.
Keeping in view the statement given by the learned counsel for the opposite parties, no purpose would be served by keeping the petition pending.
Accordingly, without entering into the merit of impugned order at this stage, opposite parties are permitted to pass fresh order within three days in view of undertaking given before the Court. It shall be open to the opposite parties to post the petitioner on the post of Deputy Director anywhere in the State of U.P.
Subject to aforesaid, the writ petition stands disposed of.
