By order dated 21.4.2010, the matter was referred to the Mediation and Conciliation Centre for amicable settlement between the parties. It was also directed that the applicant shall deposit Rs.8000/- towards maintenance and expenses of the wife for appearing before the Mediation Centre. It was also directed that in meanwhile, no coercive process shall be issued against the applicant. On the next date i.e. 3.3.2011 fixed in the matter, it was found that the order dated 21.4.2010 was not complied with and Rs.8000/- was not deposited. None was present for the applicant on that date also. In this event, the stay order dated 21.4.2010 was vacated. Today, learned counsel for the applicant and learned counsel for opp. party No.2 are present. Learned counsel for opp. party No.2-Smt. Rubiya, submits that the parties want reconciliation.
In view of the above, the applicant is permitted to deposit Rs.8000/- by way of bank draft with the Mediation Centre within ten days days from today. In case the bank draft is deposited with the Mediation Centre, the stay order dated 21.4.2010 shall continue.
List this case after two months before the appropriate Bench. The matter shall not be treated as tied up or part heard to this Bench.
